Automatic Enrollment Implementation

Is automatic enrollment permissible under law?
Partially

Explanation:
State employees hired on or after July 1, 2015 are automatically enrolled in the state plan, and political subdivisions participating in the state’s deferred compensation program are also permitted to automatically enroll their employees. However, those not participating in the state plan are not permitted to use automatic enrollment.

Relevant State Laws -Wyo. Stat. Ann. § 9-3-509, § 9-3-502

“State employees hired or returning to employment on or after July 1, 2015 will be automatically enrolled in the state’s deferred compensation plan and to contribute three percent of pre-tax compensation, unless electing otherwise.” The statute’s automatic enrollment provisions do not apply to any member of the legislature participating in the program solely in his or her capacity as a state legislator. Wyo. Stat. Ann. § 9-3-509

Wyo. Stat. Ann. § 9-3-502 permits political subdivisions to provide for automatic enrollment of new employees into the state’s deferred compensation program, and also provides that any employee may enter into a written agreement with a separate deferred compensation program established by a county, city, town or other political subdivision to defer any part of his compensation for investment.

Wyo. Stat. Ann. § 9-3-502 also provides that any employee may enter into a written agreement with a separate deferred compensation program established by a county, city, town or other political subdivision to defer any part of his compensation for investment.
