Are automatic enrollment and automatic escalation permissible under law?
State employees hired on or after July 1, 2007 are automatically enrolled in the state plan. Any political subdivision may implement automatic enrollment in their plan.

West Virginia permits employers to withhold wages if required by law or authorized for union or club dues, pension plans, payroll savings plans, credit unions, charities and hospitalization and medical insurance. W. Va. Code Ann. § 21-5-1
State employees hired on or after July 1, 2007, are required to defer ten dollars per pay period to the state’s deferred compensation plan unless electing otherwise. Also, any political subdivisions are authorized to establish an automatic enrollment program for its deferred compensation plan. W. Va. Code Ann. § 5 10B-3a
